The Law is on Your Side (Statute 468.8419)
Florida is one of the few states that strictly regulates mold professionals. The state legislature realized that allowing one company to do everything creates a dangerous conflict of interest.
Under Florida Statute 468.8419, a licensed Mold Assessor is generally prohibited from performing mold remediation on a property they have inspected within the last 12 months.
Why does this law exist? To protect you. If the person testing your air also owns the company that sells the $10,000 cleanup job, they have a financial incentive to exaggerate the problem.
The Financial Conflict: Why Separation Matters
When you hire a “One-Stop-Shop” for mold, you are opening yourself up to two major risks:
- False Positives (The Upsell): A dishonest company might use scare tactics, pointing to harmless dust or humidity stains and calling it “Toxic Black Mold” just to sell you a remediation package you don’t need.
- False Negatives (The “Rubber Stamp”): If you hire a remediation company to check their own work after they finish cleaning, do you think they will fail themselves? Unlikely. They might “pass” a room that is still contaminated just to close the job and get paid.
The “Gold Standard” 3-Step Process
To ensure your Fort Myers home is truly safe, you should follow the protocol recommended by the IICRC (Institute of Inspection, Cleaning and Restoration Certification) and Florida Law:
- Step 1: The Assessment (That’s Us). You hire an independent Mold Assessor (Florida Mold Consultants) to inspect, test, and write a “Protocol.” We have no incentive to lie because we don’t do the cleaning.
- Step 2: The Remediation. You hire a separate remediation company to follow our Protocol. They are legally bound to follow the instructions we wrote.
- Step 3: The Clearance Test. We return to test the air again. We act as the “Judge” to ensure the remediator did their job correctly. If the air isn’t clean, they have to come back and fix it at their own cost.
